Terms of Service — Camp Kokanee

Effective date: February 9, 2025

Acceptance By using the Camp Kokanee website, apps, community platforms, registering for online events, or purchasing Camp Kokanee merchandise (collectively, the “Services”), you agree to these Terms of Service. If you do not agree, do not access or use the Services.

1. Who May Use the Services

• You must be at least 13 years old to create an account or use the Services without parental consent. Users under 18 must have consent from a parent or legal guardian and the guardian must accept these Terms on their behalf.
• You represent that information you provide is accurate and that you will keep it current.

3. Accounts and Registration

• Some parts of the Services require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Notify Camp Kokanee immediately of any unauthorized use or security breach. Camp Kokanee is not liable for losses from unauthorized account activity unless caused by the organization’s gross negligence.

4. Online Activities and Conduct

• You agree to follow community rules, respect other members, and not post unlawful, abusive, harassing, threatening, defamatory, obscene, or infringing content.
• Prohibited activities include impersonation, spamming, distributing malware, exploiting or cheating in online games, and attempting to access restricted areas.
• Camp Kokanee reserves the right to remove content, suspend or terminate accounts, and ban users who violate policies.

5. Merchandise Sales and Orders

• Product listings, prices, and availability are posted on the store. Camp Kokanee reserves the right to correct pricing errors, limit quantities, or refuse orders.
• Payment is required at the time of purchase. Accepted payment methods are displayed at checkout.
• Shipping, delivery times, taxes, and return/refund policies are posted in the Store Policies. Returns or exchanges may require proof of purchase and must follow the posted procedure.

6. Intellectual Property

• All content on the Services (designs, text, graphics, logos, software, images, audio, and other material) is owned or licensed by Camp Kokanee and protected by copyright, trademark, and other laws.
• You may view and download content for personal, noncommercial use only. You may not reproduce, distribute, modify, create derivative works, sell, or exploit content without prior written permission.
• If you submit user-generated content (UGC), you grant Camp Kokanee a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, publish, translate, distribute, and display that content in connection with the Services and promotion. Do not submit content you do not own or have rights to.

7. Digital Collectibles and Limited Editions

• Limited-run merchandise, digital drops, or collectible items may be subject to special terms (e.g., maximum purchase quantities, waitlists, resale restrictions). Those terms will be disclosed at time of sale.
• Ownership of purchased physical or digital collectibles does not transfer Camp Kokanee’s underlying intellectual property rights unless explicitly stated.

8. Payments, Fees, and Refunds

• Fees for Services, events, or merchandise are as listed. Camp Kokanee may change fees with notice. Refund eligibility is governed by posted refund policies; digital products (including digital downloads, digital art, or digital access) may be non-refundable except where required by law.
• In case of canceled online events or product unavailability, Camp Kokanee’s liability is limited to refunding amounts paid or offering credit.
• All sales of physical merchandise are final.

9. Privacy

• Personal information is collected and processed according to Camp Kokanee’s Privacy Policy. By using the Services, you consent to the collection, use, and sharing of information as described in that policy.

10. Third-Party Services and Links

• The Services may include links to third-party websites, payment processors, fulfillment partners, or platforms. Camp Kokanee is not responsible for third-party practices or content. Use linked services at your own risk.

11. Disclaimers and Limitation of Liability

• The Services are provided “as is” and “as available.” Camp Kokanee disclaims warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• To the maximum extent allowed by law, Camp Kokanee’s total liability for claims related to the Services or products is limited to the amount you paid to Camp Kokanee in the 12 months preceding the claim (or $100 if no payments were made). Camp Kokanee is not liable for indirect, incidental, special, consequential, or punitive damages.

12. Indemnification

• You agree to indemnify and hold Camp Kokanee and its officers, directors, employees, agents, and partners harmless from claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, violation of law, or infringement of third-party rights.

13. Termination and Suspension

• Camp Kokanee may suspend or terminate accounts, block access, or remove content for violation of these Terms or when required by law. Users may close their accounts per account settings or by contacting support; certain information may be retained as required by law or for legitimate business purposes.

14. Modifications to Services and Terms

• Camp Kokanee may modify or discontinue features or the Services with notice. Camp Kokanee may update these Terms; material changes will be communicated, and continued use after notice constitutes acceptance.

15. Dispute Resolution and Governing Law

• Try to resolve disputes informally by contacting support. If unresolved, disputes will be governed by the laws of [State/Country], without conflict-of-law rules. Any legal action must be brought in the courts located in [Venue], unless otherwise required by law.

16. Miscellaneous

• These Terms, together with the Privacy Policy and any other policies posted by Camp Kokanee, form the entire agreement regarding use of the Services.
• If any provision is unenforceable, the remaining provisions remain in full force.
• Headings are for convenience and do not affect interpretation.
